Legal basis for processing activities

  • Agreement on the provision of legal services
  • Providing personal data is an obligation of the data subject – client (hereinafter referred to as the “Client”) resulting from the above mentioned Agreement

 

The purpose of processing activities

Provision of legal services according to the Agreement on the provision of legal services
Recipients to personal data

  • public authorities (for example courts and administrative authorities)
  • providers of maintenance information system
  • other recipients according to Client needs and instructions

 

Duration of the processing personal data

Personal data will be processed for the period of validity of the aforementioned Agreement and after its termination will be handled according to the valid legal regulations, especially Act No. 85/1996 Coll. (Act on Advocacy), Act No. 499/2004 Coll. (Act on Archiving and File Service) and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95 / 46 / EC (GDPR Regulation).

 

Rights of client

The right of access to personal data means that the Client has the right to obtain information from the Controller about whether he is processing his personal data and, if so, what data it is and how it is processed. The Client shall have the right to obtain from the data Controller without undue delay the rectification of inaccurate personal data concerning him. The Client shall have the right to have incomplete personal data completed.

The right to erasure personal data. The Client shall have the right to obtain from the Controller the erasure of personal data concerning him without undue delay and the Controller shall have the obligation to erase personal data without undue delay.

The Client shall have the right to obtain from the Controller restriction of certain cases of processing of his personal data. Against of processing, which is based of legitimate interests of the Controller or a third party, is necessary for compliance with a legal obligation, the Client have the right to object at any time to processing of personal data.

The right to data portability gives the possibility to obtain personal data, which the Client has provided to the Controller in a structured, commonly used and machine-readable format. The Client has the right to transmit those data to another controller if it is technically possible, and the Client may require to transmit those data between controllers.

The right to withdraw consent to the processing of personal data at any time shall not apply, as the Client’s personal data are processed due to the performance of the Agreement and not on the basis of the consent to the processing.
Shall the Client be unsatisfied with the processing of his personal data by the Controller, he has a right to file a complaint directly to the Controller or contact the Office of personal data protection.
